{"id":563,"date":"2010-06-09T20:03:35","date_gmt":"2010-06-09T20:03:35","guid":{"rendered":"http:\/\/www.nyonlinerealty.com\/blog\/?p=563"},"modified":"2010-06-09T21:31:44","modified_gmt":"2010-06-09T21:31:44","slug":"judge-orders-bofa-to-halt-all-foreclosure-sales-in-utah","status":"publish","type":"post","link":"https:\/\/blog.nyonlinerealty.com\/?p=563","title":{"rendered":"Judge Orders BofA to Halt All Foreclosure Sales in Utah"},"content":{"rendered":"<div id=\"articleColumn1\">\n<p>A judge in St. George, Utah has issued a <a href=\"http:\/\/www.envisionlawfirm.com\/redacted_prelim0001.pdf\" target=\"_blank\">preliminary injunction<\/a> stopping all foreclosure sales in the state by <a href=\"http:\/\/www.bankofamerica.com\/\" target=\"_blank\">Bank of America<\/a> and its subsidiary <a href=\"http:\/\/www.recontrustco.com\/\" target=\"_blank\">ReconTrust<\/a>.<\/p>\n<p>The decision, by 5th District Court Judge James L. Shumate, was based on the grounds that the nation\u2019s largest mortgage servicer and its related companies are not registered to do business in Utah.<\/p>\n<p>The court order puts a temporary freeze on all trustee sales of homes foreclosed by BofA, until it can be determined if the bank is properly licensed to operate in the state.<\/p>\n<\/div>\n<div id=\"articleColumn2\">\n<p>According to a number of local media outlets, if the temporary injunction is made permanent, it has the potential to affect thousands of Utah borrowers facing foreclosure.<\/p>\n<p>John Christian Barlow, the attorney who petitioned for the injunction, told <a href=\"http:\/\/www.kcsg.com\/view\/full_story\/7816217\/article-Judge-James-L--Shumate-Orders-Halt-to-Bank-of-America-Foreclosures-in-Utah?instance=home_stories1\" target=\"_blank\"><em>KCSG Television<\/em> in St. George<\/a> that Bank of America has over 1,100 homes in Utah in foreclosure this month alone, \u201cand the numbers keep growing,\u201d he said.<\/p>\n<p>Bank of America issued the following statement to <a href=\"http:\/\/www.abc4.com\/news\/local\/story\/Utah-Judge-Stops-Bank-of-America-Foreclosures\/YW-V-s1eqUmFP2Ez3B98bA.cspx\" target=\"_blank\"><em>ABC4<\/em> in Salt Lake City<\/a>: \u201cAlthough we are governed by and operate in compliance with federal laws and regulations, we halted residential foreclosures in Utah in compliance with the recent preliminary injunction.
