{"id":1106,"date":"2010-09-03T15:36:43","date_gmt":"2010-09-03T15:36:43","guid":{"rendered":"http:\/\/www.nyonlinerealty.com\/blog\/?p=1106"},"modified":"2010-09-03T16:14:15","modified_gmt":"2010-09-03T16:14:15","slug":"fannie-mae-says-foreclosure-delays-represent-a-breach-by-the-servicer","status":"publish","type":"post","link":"https:\/\/blog.nyonlinerealty.com\/?p=1106","title":{"rendered":"Fannie Mae Says Foreclosure Delays Represent a Breach by the Servicer"},"content":{"rendered":"<div id=\"articleColumn1\">\n<p>By: Carrie Bay<\/p>\n<p>The nation\u2019s largest mortgage company is about to start cracking down on servicers for letting delinquent loans languish too long without action.<\/p>\n<p><a href=\"http:\/\/www.fanniemae.com\/\" target=\"_blank\">Fannie Mae<\/a> issued a <a href=\"https:\/\/www.efanniemae.com\/sf\/guides\/ssg\/annltrs\/pdf\/2010\/svc1012.pdf\">notice this week<\/a> alerting servicers that it is monitoring <em>all<\/em> delinquent loans in its portfolio and mortgage-backed securities (MBS) pools to ensure foreclosures are handled within an acceptable time frame.<\/p>\n<p>By the tone of Fannie\u2019s announcement, it wants these nonperformers off its books as quickly as possible. The GSE says it may assess penalties for poor servicer performance when it comes to completing foreclosures in a timely manner.<\/p>\n<\/div>\n<div id=\"articleColumn2\">\n<p>Fannie says it will be keeping tabs on all whole mortgages, participation pool mortgages, and MBS pool mortgages with a special servicing option referred to an attorney or trustee to initiate foreclosure proceedings on or after July 1, 2010. Company officials will be scrutinizing servicer data to identify delays in the default management process.<\/p>\n<p>According to the GSE, it may elect to perform a more extensive servicing review \u2013 possibly on-site \u2013 to further evaluate the actions the servicer took on certain mortgage loans. Servicers must send the requested documentation or make it available\u2026within the time frame specified in the notification. If the servicer fails to do so, Fannie Mae may assess compensatory fees without first reviewing the loan or exercise other available remedies, the GSE warned.<\/p>\n<p>Fannie Mae will communicate any performance deficiencies to the servicer, who will then be given an opportunity to explain any mitigating circumstances or factors that justify the servicing actions it took or did not take within a reasonable time frame.<\/p>\n<p>\u201cA compensatory fee not only compensates Fannie Mae for damages but also emphasizes the importance placed on a particular aspect of the servicer\u2019s performance,\u201d the GSE stated in its servicing guide.<\/p>\n<p>Fannie also updated the allowable foreclosure time frames for four states: Florida \u2013 185 days; Maryland \u2013 90 days; Nevada \u2013 150 days; New York (upstate) \u2013 300 days; and New York (downstate) \u2013 420 days.<\/p>\n<p><a href=\"http:\/\/www.dsnews.com\/articles\/fannie-mae-says-foreclosure-delays-represent-breach-by-servicer-2010-09-02\">http:\/\/www.dsnews.com\/articles\/fannie-mae-says-foreclosure-delays-represent-breach-by-servicer-2010-09-02<\/a><\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>By: Carrie Bay The nation\u2019s largest mortgage company is about to start cracking down on servicers for letting delinquent loans languish too long without action.
